Re-use of redundant building stock can provide a justifiable route through planning.  Did you know that there are many different technical methods of enhancing existing buildings to bring them up to and beyond current building performance requirements.  Many organisations have redundant building stock, let us help you take the sustainable approach to the re-use of existing investments.

Domestic

Some extensions may be permissible under the permitted development legislation, but not all, and we would advise anyone looking to extend their property, even if they think it will meet the permitted development rules to check with their local authority and get the appropriate plans and building regulations in place. 

We can assist in the interpretation of the legislation, getting a record of consent to develop and providing drawings suitable for building control.

Class Q -
Barn Conversions

Using permitted development rights to create your country home.

In 2014 a planning policy was introduced to allow for the conversion of agricultural buildings.  This permitted development right, allows for the conversion of a barn into a residential home.

As with all permitted development rights, there are certain criteria that need to be met, as a concise overview, these are –

  • The building must have been used for agricultural purposes on 20th March 2013, if redundant before this date, proof needs to be supplied of its agricultural use.  If the building was built after this date, it must have been used for agricultural purposes for 10 years.

  • An agricultural tenancy cannot have been terminated within 1 year of the application.

Class Q can be used in place of full planning, offering a more straightforward route to building a home in the countryside.

The total floorspace of larger buildings cannot exceed 465 m2.  However, there is potential to build 3 large buildings >100m2 or 5 smaller dwellings <100m2. 

Partial demolition is permitted but extending the buildings in anyway is not permitted.  Therefore, maximising the external space is a must.

Structural works are permitted to allow the function of a building as a dwellinghouse, such as installing or replacing roof, windows, doors etc., but the current structure must be capable of functioning as a residence without the structural additions or reinforcements.

The replacement or installation of services such as electricity, gas, water and drainage are also permitted.

Planning Enforcement

Served with an Enforcement Notice, Planning contravention notice or received a warning letter? Don’t panic!

Receiving a letter from planning enforcement can be alarming.  In most cases, you have been reported to the planning department for erecting an extension or structure without the correct planning in place.  Planning enforcement notices are becoming more commonplace, as, the permitted development rules that where introduced can be misleading. 

 

Most of the time, to address the enforcement notice, you will need to submit a retrospective planning application, these are done in much the same way as a standard planning application, through the local authority, but will require detailed drawings of what has been built and what was there before. 

The good news is, once you have engaged a team of professionals to deal with your planning enforcement notice, they will get in touch with the officer in charge of your case and this will halt any further action being taken against you, once they are informed of what the plan is to deal with the structure in question.
